Chark, Ltd., a Nevada limited liability company (“Chark,” “us,” “we,” “our,” or “ourselves“), is dedicated to protecting your privacy and handling any personally identifiable information we obtain from you with care and respect.
This Privacy Policy sets forth our policy with respect to information, including personally identifiable information, that is collected from users of and/or visitors to LawExams.com, our mobile applications for iOS and Android, and any other websites, online software, or mobile applications operated by Chark (collectively, the “LawExams Service“).
This Privacy Policy applies to personally identifiable information collected through the LawExams Service and does not apply to any other information collected by Chark through any other means. As used in this Privacy Policy, Chark includes all of its subsidiary and affiliated entities.
When this Privacy Policy uses the term “personally identifiable information” or “Personal Information,” we mean information that identifies, relates to, or could reasonably be linked with a particular individual or household, such as an individual’s name, address, email, and phone number.
This Privacy Policy does not cover the information practices of other companies or organizations that advertise our services or whose services, plug-ins, or technologies are integrated into the LawExams Service, and who may use cookies, software development kits (SDKs), web beacons (pixel tags), advertising identifiers, and other methodologies to collect information and serve advertising. Please review the privacy policies of those third parties.
By accessing or using the LawExams Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the LawExams Service.
Collection of Personal Information
Typically, the personally identifiable information we receive comes directly from users like you who are interested in using the LawExams Service, signing up as a user, and obtaining various products and services from us. We collect Personal Information when you sign up as a user, contact us with inquiries, purchase products or services, or participate in promotional offers.
The personally identifiable information we collect includes, without limitation:
- Contact information, including name, email address, mailing address, and phone number
- Location data
- Age or date of birth
- Unique identifiers such as username, account number, and password
- Preferences information, such as the types of emails you would like to receive from us
- Promotional offers you may be interested in
- Credit card and billing information
- Other Personal Information you voluntarily provide to us through the websites, the mobile application, on the phone, via email, or in other communications
Information Collected Through Technology, Cookies, and Mobile SDKs
We also collect information through technology to make the LawExams Service more interesting and useful. For instance, when you visit one of our websites or use our mobile application, your IP address is collected. An IP address is often associated with the network through which you enter the Internet, such as your ISP, mobile carrier, or your company. We use IP addresses to collect information regarding the frequency with which our users visit various parts of the LawExams Service, to estimate general (coarse) location, to help diagnose problems with our servers, to detect and prevent fraud, and to administer the LawExams Service.
When you use the LawExams Service we may store a small amount of information on your computer or device. On our websites, this information may take the form of a “cookie” or similar file. Cookies are small files stored on your device. We use cookies to deliver content specific to your interests and so you are not required to reenter your account data every time you connect. Through your web browser you can choose to be warned each time a cookie is being set, or you can choose to delete or turn off all cookies at any time. Each browser is a little different, so look at your browser’s Help menu to learn the correct way to modify your cookie settings. Our websites and application may also use a variety of technical methods for tracking purposes, such as JavaScript snippets, pixel tags, software development kits (SDKs), and mobile advertising identifiers. We may use these technical methods to analyze traffic patterns, such as the frequency with which our users visit or interact with various parts of the LawExams Service. We also maintain standard web and server logs that record data about visitors and users of the LawExams Service.
Mobile applications. When you use our mobile application, we and our service providers and advertising partners may automatically collect device and usage information, including mobile advertising identifiers (the Apple Identifier for Advertisers (“IDFA“) on iOS and the Google Advertising ID (“AAID“) on Android), device identifiers and settings, operating system and version, app version, network and mobile carrier information, IP address, coarse/approximate location, in-app activity, crash and diagnostic data, and information about the advertisements you are shown and interact with.
Chark and our marketing partners — including third-party service providers, advertisers, advertising networks and platforms, advertising agencies, analytics providers, and data brokers and aggregators — may use automated means to collect various types of information about you and the device used to access the LawExams Service. A representative, non-exhaustive list of passively or automatically collected information may include: network or Internet protocol address; browser type (e.g., Chrome, Safari, Firefox, Edge); operating system type (e.g., Windows, macOS, iOS, Android); the name of your Internet service provider, mobile carrier, and domains used; device identifiers and advertising identifiers; device and browser settings; the pages or screens of the LawExams Service you have visited; pages or services visited before and after; the type of handheld or mobile device used; location information; the content and advertisements you have accessed, seen, forwarded, and/or clicked on; time details per visit; the path followed within the LawExams Service; other parameters about the device operating system and your IT environment; and conversion rates, marketing and conversion data, statistics, reports, and analytics, including your interactions with emails we send and reviews and surveys regarding the LawExams Service.
If you are accessing the LawExams Service from a computer or mobile device, you may be asked to share your geo-location information with us. If you agree to the collection of location data, in most cases you will be able to turn off such data collection at any time through the privacy settings of your computer, browser, or mobile device.
In-App Advertising and Google AdMob
Our mobile application is supported by advertising. We use Google AdMob, a mobile advertising service provided by Google LLC (“Google“), to serve advertisements within the application on both iOS and Android.
What this means for your data. As a result of our use of Google AdMob and the Google Mobile Ads SDK, we and Google (acting as a third party) collect, use, and share certain information in connection with the ads served in our application. This information may include your device’s advertising identifier (IDFA or AAID), IP address, coarse/approximate location derived from your IP address, device and operating system information, and data about your interactions with ads (such as impressions, clicks, and viewability). Google uses this information to serve and measure ads, to cap the frequency of ads, to detect and prevent fraud and abuse, to debug, and for other purposes described in Google’s policies.
Non-personalized advertising. We have configured our application to request non-personalized ads from Google AdMob. Non-personalized ads are not based on a user’s past behavior or interests; however, they may still use contextual information (such as the content of the current screen, coarse location based on IP address, and general device information) and limited data for frequency capping, aggregated ad reporting, and fraud and abuse prevention. Non-personalized ads still rely on the collection and processing of the data described above.
Google’s role and policies. Google acts as an independent third party with respect to the data it collects through the Google Mobile Ads SDK, and Google’s collection and use of that data are governed by Google’s own privacy policy and terms. Your advertising choices. You can limit ad tracking and reset or delete your advertising identifier through your device settings:
- iOS: Through Apple’s App Tracking Transparency (ATT) framework, you control whether apps may access the IDFA. You can also adjust tracking and personalization preferences in Settings → Privacy & Security → Tracking and Settings → Privacy & Security → Apple Advertising.
- Android: You can reset or delete your advertising ID and opt out of ad personalization in Settings → Google → Ads (or Settings → Privacy → Ads).
Because we serve non-personalized ads, you will continue to see ads regardless of these settings, but the data used to serve them is limited as described above.
Users in the European Economic Area (EEA), United Kingdom, and Switzerland. Where required by applicable law, before serving ads we will present a consent message through a Google-certified Consent Management Platform (CMP) using Google’s User Messaging Platform (UMP) SDK and the IAB Europe Transparency and Consent Framework (TCF). This allows you to provide or withhold consent for the access to and use of information on your device and for the data processing described above. Your ad experience and the data processed will reflect the choices you make through that consent mechanism.
Children. The LawExams Service, including our application, is not directed to children and is intended for users 13 years of age and older. We do not request child-directed treatment for our ad inventory and do not knowingly serve ads to children under 13. See the “Children’s Information” section below.
Use of Personal Information
We may use your personally identifiable information in many ways, such as to send you products or services you have requested. Sometimes we hire companies to help deliver products or services, such as a third-party content provider or a payment processor; in those instances, there is a need to share your information with those companies. We may also use all information collected through the LawExams Service for research regarding the effectiveness of the LawExams Service and for our business planning, marketing, advertising, and sales efforts.
We may take your personally identifiable information and make it non-personally identifiable, either by combining it with information about other individuals or by removing characteristics (such as your name) that make the information personally identifiable to you. There are no restrictions under this Privacy Policy upon our right to aggregate or de-personalize your Personal Information, and we may use and/or share the resulting non-personally identifiable information with third parties for any lawful purpose.
We may store personally identifiable information ourselves, or such information may be included in databases owned and maintained by our affiliates, agents, or service providers.
We may also use and disclose the personally identifiable information we collect to:
- Send you requested product or service information
- Respond to customer service requests
- Administer your account
- Send you newsletters, text messages, or email communications
- Respond to your questions and concerns
- Improve our websites, application, and marketing efforts
- Conduct internal quality improvement or business analysis
- Process payments for bills and invoices
- Serve, measure, and improve advertising, subject to the “In-App Advertising and Google AdMob” section above
- Detect, prevent, and respond to fraud, abuse, security incidents, and illegal activity
- Comply with legal obligations and enforce our agreements
We may use your Personal Information and usage data for the performance of the services or transaction for which it was given and for the basic purpose of the LawExams Service. We may use your Personal Information in connection with other products, services, promotions, or contests we may offer, and for our private, internal reporting and security assessments. We may also send you messages related to certain features or your activity, and news or updates about changes to the LawExams Service.
We may use publicly available Personal Information posted on social media, including profile information and photos, for purposes of assisting us and our marketing partners with marketing, advertising, and contact-management activities.
How We Share and Disclose Information
We may share or disclose information as described throughout this Privacy Policy and as follows:
- Service providers. With vendors and service providers who perform services on our behalf, such as hosting, payment processing, analytics, advertising, email delivery, and customer support.
- Advertising partners. With advertising networks and platforms, including Google, as described in the “In-App Advertising and Google AdMob” section.
- Affiliates. With our subsidiaries and affiliated entities.
- Legal and protective disclosures. As described in “Additional Disclosures” below.
- Business transfers. As described in “Purchase or Sale of Businesses” below.
- With your direction or consent. When you otherwise direct us to share your information.
We may share aggregated or de-identified information that cannot reasonably be used to identify you for any lawful business purpose.
Messages and Communications
Comments or questions sent to us using email or messaging forms will be shared with Chark staff who are most able to address your concerns. We will archive your messages once we have made our best effort to provide you with a complete and satisfactory response.
By providing your email address, you expressly opt in to the receipt of email communications from us and our affiliates, agents, or contractors for or related to goods or services, your account, and other services. By providing this express consent, you specifically waive any claim you may have for the sending of such emails, including any claim under federal or state law and specifically any claim under the CAN-SPAM Act, 15 U.S.C. § 7701, et seq. By providing an email address, you represent that you are the subscriber or owner of, or have the authority to use and provide consent to contact, that email address.
Even if you have given us permission to send emails or text messages to you, you may revoke that permission at any time by following the “unsubscribe” information at the bottom of the email or by notifying us by email.
Third-Party Services
Chark uses third-party vendors to help us manage our email communications with you. When you click a link in an email, you may temporarily be redirected through one of the vendor’s servers (although this process will be invisible to you), which will register that you clicked that link.
Some of Chark’s credit card processing is handled by Stripe, Inc. (https://stripe.com). Stripe maintains customer and payment information for purchases. More information about Stripe’s privacy terms is available at https://stripe.com/privacy.
Our websites use Google Analytics to track usage and trends. Google Analytics collects various data, including the page URL, page title, IP address, and page language. You can review Google’s Privacy Policy at https://policies.google.com/privacy and learn how Google Analytics uses data at https://support.google.com/analytics/answer/6004245. Google provides controls to limit its collection of data, including the Google Analytics opt-out browser add-on, available at https://support.google.com/analytics/answer/181881.
Our mobile application uses Google AdMob for in-app advertising, as described in the “In-App Advertising and Google AdMob” section above.
This Privacy Policy does not cover the use of cookies, identifiers, or web beacons by any third parties, so be sure to review the privacy policy of any third party whose services you use or whose technologies are integrated into the LawExams Service.
Social Media / Remarketing
When we interact with you through our content on social media platforms, third-party platforms, websites, applications, integrations, and services of our marketing partners, we may obtain information regarding your interaction with that content, such as content you have viewed and information about advertisements within the content you have been shown or may have clicked on. For a description of how social media services and other third-party platforms handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings.
We may participate in remarketing, retargeting, and behavioral advertising services. In such cases, we may provide Personal Information such as your email address and phone number to third-party services such as Facebook (Meta), Google, Microsoft, or X (Twitter) to determine whether you are a registered account holder with one or more of those services. (Note: this remarketing activity applies to our websites and other marketing channels; as stated above, our mobile application requests non-personalized ads through Google AdMob.)
We may also collect publicly available Personal Information posted on social media platforms and profiles. When you engage with our content on or through social media platforms or other third-party platforms, you may allow us to have access to certain Personal Information in your profile, which may include your name, email address, photo, gender, birthday, location, an ID associated with the applicable platform, your list of friends or connections, and your posts or “likes.”
Your Privacy Choices
In addition to the advertising choices described in the “In-App Advertising and Google AdMob” section, you may exercise the following choices:
- Email and text messages: Unsubscribe using the link in any email or by contacting us.
- Cookies: Adjust your browser settings to refuse or delete cookies.
- Location: Turn off location sharing through your device or browser settings.
- Mobile advertising identifier: Reset or limit your IDFA (iOS) or AAID (Android) through your device settings.
- Analytics: Use the Google Analytics opt-out browser add-on.
- Account information: Contact us to review or update your account information.
Links to Third-Party Websites
The LawExams Service includes links to other websites whose privacy practices may differ from those of Chark. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.
Security
The LawExams Service has security measures in place that are intended to help protect against the loss, misuse, unauthorized access, or alteration of information under our control, both during transmission and once the information is received. These measures include encryption of data using Transport Layer Security (TLS/SSL) when you send Personal Information electronically to the LawExams Service.
However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from the LawExams Service may not be secure. You should take special care in deciding what information you send to us via email. Although we will do our best to protect your Personal Information, we cannot guarantee the security of data while you are transmitting it to us; any such transmission is at your own risk.
Data Retention
We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the LawExams Service, comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. When Personal Information is no longer needed, we will take reasonable measures to delete, anonymize, or de-identify it. Retention periods may vary depending on the type of information and applicable legal requirements.
Do Not Track and Global Privacy Control
Some browsers offer a “Do Not Track” (DNT) signal. We currently do not respond to DNT signals because there is no consistent industry standard for how to interpret them. Where required by applicable law, we will treat recognized opt-out preference signals, such as the Global Privacy Control (GPC), as a valid request to opt out of the “sale” or “sharing” of Personal Information for the browser or device from which the signal is received.
International Privacy Laws; Storage and Transfer of Your Data
The LawExams Service is operated from, and your information is stored and processed in, the United States. If you are using the LawExams Service from outside the United States, please be aware that you are sending information (including potentially Personal Information) to the United States. Any information sent to Chark will be held in accordance with applicable privacy laws and this Privacy Policy. By using the LawExams Service, you consent to the transfer of your information to the United States and other countries that may have data-protection rules different from those of your country.
Where we transfer Personal Information out of the EEA, United Kingdom, or Switzerland, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses, where required.
EEA, UK, and Swiss Privacy Rights (GDPR)
If you are located in the European Economic Area, the United Kingdom, or Switzerland, the collection, processing, and use of Personal Information is governed by the EU General Data Protection Regulation, the UK GDPR, and applicable national laws. For these purposes, Chark is the data controller, and any inquiry regarding the collection or processing of your data should be addressed to the Contact Information below.
Legal bases. We process Personal Information where: (a) you have given consent (for example, through the consent mechanism for advertising described above); (b) processing is necessary to perform a contract with you; (c) processing is necessary to comply with a legal obligation; or (d) processing is necessary for our legitimate interests (such as operating, improving, and securing the LawExams Service and supporting it through advertising), provided those interests are not overridden by your rights.
Your rights. Subject to applicable law, you have the right to request access to, correction of, or deletion of your Personal Information; to restrict or object to certain processing; to data portability; and to withdraw consent at any time (without affecting the lawfulness of processing before withdrawal). You also have the right to lodge a complaint with a supervisory authority.
To exercise these rights, please write to us or contact us by email using the Contact Information below. There is no charge for requesting details of the Personal Information we hold about you, and we will respond within the time required by applicable law (generally within one month).
United States State Privacy Rights
Depending on your state of residence, you may have certain rights regarding your Personal Information under state privacy laws, including (where applicable) the laws of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive consumer privacy laws.
Subject to applicable law and to the verification and exception provisions of the relevant statute, these rights may include:
- The right to know/access the categories and specific pieces of Personal Information we have collected about you;
- The right to correct inaccurate Personal Information;
- The right to delete Personal Information we have collected from you;
- The right to portability (to obtain a copy of your Personal Information in a portable format);
- The right to opt out of the “sale” or “sharing” of Personal Information and of targeted/cross-context behavioral advertising; and
- The right to be free from discrimination for exercising your privacy rights.
Sale/sharing for advertising. Certain disclosures of identifiers and online activity information to advertising and analytics partners may be considered a “sale” or “sharing” (or processing for “targeted advertising”) under some state laws. As described above, our mobile application requests non-personalized ads through Google AdMob, and where required we honor recognized opt-out preference signals (such as Global Privacy Control) on our websites.
How to exercise your rights. Please submit a request using the Contact Information below. We will verify your request as required by law. You may use an authorized agent to submit a request on your behalf where permitted. We will not discriminate against you for exercising your rights. If we deny your request, we will notify you and, where required, explain how you may appeal.
California “Shine the Light.” California residents may request information about our disclosure of certain Personal Information to third parties for those third parties’ direct marketing purposes. Please make any such request using the Contact Information below.
Children’s Information
The LawExams Service is not directed to children, and we do not knowingly collect Personal Information from, or sell or “share” the Personal Information of, children under the age of 13. Our mobile application is intended for users 13 years of age and older, and we do not knowingly serve child-directed advertising. If you are a parent or guardian who has discovered that your child under the age of 13 has submitted Personal Information without your permission or consent, please contact us and we will remove the information at your request.
Non-Personal Information
We may use and share non-personal information — that is, de-identified information that cannot reasonably be used to identify you — for any lawful business purpose without any obligation or accounting to you. For example, we may use non-personal information for developing and providing products and services to other users and third parties. We may use your Personal Information to generate non-personal information; when we do so, we will take reasonable measures to ensure that the non-personal information is no longer personally identifiable and cannot later be used to identify you. We may also disclose non-personal, aggregate, anonymous data in a de-identified format to investors and other third parties.
Purchase or Sale of Businesses
We may buy, merge with, or partner with other companies or businesses and, in so doing, acquire or transfer information. We may also sell, assign, or otherwise transfer such information in the regular course of business. Information collected through the LawExams Service may be among the transferred business assets. In the event that a portion or substantially all of our assets are sold or transferred to a third party, your information would likely be a transferred business asset, and you agree to such a transfer.
In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your Personal Information is treated, transferred, or used.
Additional Disclosures
We will disclose Personal Information when we believe in good faith that such disclosure is required by law, including, for example, to comply with a court order or subpoena; to enforce this Privacy Policy or our other agreements; to protect your safety or security; and/or to protect the safety and security of the LawExams Service, us, and/or third parties, including the safety and security of property that belongs to us or third parties. We may disclose Personal Information to any person performing audit, legal, operational, or other services for us.
Changes and Updates
We may revise this Privacy Policy from time to time as we add new features or modify the way in which we manage information, or as laws change that may affect our services. If we make material changes to this Privacy Policy, we will post notice on the LawExams Service prior to the changes becoming effective. Any revised Privacy Policy will apply both to information we already have about you at the time of the change and to any Personal Information created or received after the change takes effect. We include a version date on this Privacy Policy consisting of the date (year, month, and day) it was last revised. We encourage you to periodically reread this Privacy Policy to see whether there have been any changes that may affect you. Your continued use of the LawExams Service after any such changes constitutes your acceptance of the new Privacy Policy. If you do not agree to this Privacy Policy or any future Privacy Policy, do not use (or continue to use) the LawExams Service.
